These terms and conditions apply to your use of shoez.site and to every purchase you make from us. The website is operated by Shoez (we, us, our). By using this website or placing an order, you agree to these terms.
1. About our products
We sell running shoes under the Shoez brand. We try to show every product, colour and size as accurately as we can, but colours can look different on different screens. Product images are for illustration.
2. Prices and payment
- All prices are in Australian dollars (AUD).
- Prices may change at any time, but the price you pay is the price shown at checkout when you place your order.
- We accept credit and debit card payments, processed securely by Stripe. We never see or store your full card number.
- Payment is taken in full when you place your order.
- If a product is listed at an obviously wrong price because of an error, we may cancel the order and refund you in full.
3. Orders
When you place an order you will receive an email confirming that we have received it. A contract is formed when we dispatch your order. We may decline or cancel an order (for example if an item is out of stock, or we suspect fraud). If we cancel, we will refund any payment in full.
4. Shipping
We ship within Australia only. Shipping costs and delivery times are set out in our Shipping Policy. Risk in the goods passes to you on delivery.
5. Returns, refunds and your consumer rights
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Change-of-mind returns are covered in our Refund & Returns Policy. Nothing in these terms limits your rights under the Australian Consumer Law.
6. Promotions and discount codes
Promotions and discount codes are subject to the conditions stated with them, cannot be exchanged for cash and may be withdrawn at any time. Only one code can be used per order unless we say otherwise.
7. Your account
If you create an account, you are responsible for keeping your password secure and for activity on your account. Please tell us straight away if you think someone else has accessed it.
8. Website use
You must not misuse this website, including by trying to gain unauthorised access, introducing viruses or interfering with its operation. We may suspend access to the website for maintenance or other reasons.
9. Intellectual property
The Shoez name, logo and original website content are owned by us. Product names, logos and images of the brands we sell, including Nike, belong to their respective owners and are used only to identify genuine products we stock. Shoez is an independent retailer and is not affiliated with or endorsed by Nike, Inc. You may not copy or use content from this website for commercial purposes without permission.
10. Limitation of liability
To the extent permitted by law, and subject to your rights under the Australian Consumer Law, we are not liable for any indirect or consequential loss arising from your use of this website or our products. Where our liability can be limited, it is limited to replacing the goods, supplying equivalent goods, or refunding the price paid.
11. Privacy
We handle your personal information as set out in our Privacy Policy.
12. Changes to these terms
We may update these terms from time to time. The version on this page when you place your order applies to that order.
13. Governing law
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that state.
